1. Acceptance of Terms

Welcome to CleanAirWhere ("Service," "Platform," "we," "us," or "our"). By accessing or using our website, mobile application, or any related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and CleanAirWhere. Please read them carefully before using our Service.

2. Description of Service

CleanAirWhere is an interactive map and business dashboard platform that:

  • Displays a public map showing businesses with real-time air quality data
  • Allows businesses to register accounts and create profiles
  • Enables businesses to pair air quality sensors (QingPing devices) using 4-digit pairing codes
  • Collects, processes, and displays air quality metrics including CO2, PM2.5, PM10, temperature, and humidity
  • Provides business owners with dashboards showing air quality trends and analytics
  • Requires admin approval before businesses appear on the public map

3. User Accounts and Registration

3.1 Account Creation

To access certain features (business dashboard, sensor pairing), you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and account credentials
  • Notify us immediately of any unauthorized access or security breach
  • Accept responsibility for all activities under your account

3.2 Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts to use this Service. By creating an account, you represent and warrant that you meet these requirements.

3.3 Business Accounts

Business accounts are intended for legitimate business owners or authorized representatives. You may only create one business profile per account. You represent that:

  • You have the authority to represent the business you register
  • All business information provided is accurate and truthful
  • You own or have permission to display the business photos you upload
  • You operate a legitimate business at the specified location

3.4 Email Verification

You must verify your email address to activate your account. We may send service-related emails to your registered email address.

4. Business Profile and Public Display

4.1 Profile Creation

After creating an account, you can create a business profile by completing the onboarding process. Your profile must include:

  • Business name
  • Physical address and accurate geographic coordinates
  • Valid contact information (email, optional phone and website)
  • Appropriate venue category

4.2 Admin Approval Process

All business profiles are subject to admin review and approval before appearing on the public map. We reserve the right to:

  • Approve or reject any business profile at our sole discretion
  • Request additional information or verification
  • Remove profiles that violate these Terms
  • Change a profile's status from "approved" to "inactive" at any time

Approval is typically completed within 24-48 hours but is not guaranteed within any specific timeframe.

4.3 Public Visibility

By creating a business profile, you explicitly consent to the public display of the following information:

  • Business name, description, and photos
  • Business location (address and map coordinates)
  • Contact information (website, email, phone if provided)
  • Venue category and facilities
  • Current and historical air quality data from your paired sensors
  • Calculated overall air quality ratings

This information will be visible to all users of the public map and may be indexed by search engines.

5. Air Quality Sensors

5.1 Sensor Pairing

You can pair QingPing air quality sensors to your business profile using 4-digit pairing codes. You agree that:

  • You own or have permission to pair the sensors to your account
  • Sensors will be installed at your registered business location
  • You will maintain sensors in proper working condition
  • You will not tamper with sensors to produce false readings

5.2 Data Collection and Display

Once paired, sensors will automatically transmit air quality data to our platform via QingPing's API. This data will be:

  • Stored in our database
  • Displayed in your business dashboard
  • Publicly displayed on the map (for approved businesses)
  • Used to calculate overall air quality ratings
  • Retained indefinitely for historical trend analysis

5.3 Sensor Responsibility

You are responsible for:

  • Purchasing, installing, and maintaining sensors
  • Ensuring sensors remain powered and connected
  • Ensuring sensors comply with QingPing's terms of use
  • Paying any fees associated with sensor hardware or QingPing services

We are not responsible for sensor malfunctions, inaccurate readings, connectivity issues, or any hardware defects. Sensor issues should be addressed directly with QingPing.

6. Subscription and Payment Terms

6.1 Free Tier

CleanAirWhere currently offers a free tier that includes basic features. We reserve the right to modify or discontinue the free tier at any time with reasonable notice.

6.2 Paid Subscriptions (Planned Feature)

We plan to offer paid subscription tiers with enhanced features. When implemented:

  • Payment will be processed through Stripe
  • Subscriptions will renew automatically unless canceled
  • You are responsible for all charges to your payment method
  • Prices are subject to change with 30 days' notice
  • Refunds will be handled according to our refund policy (to be published)

6.3 Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing period. No partial refunds will be provided for unused time in the current billing period.

7. User Conduct and Prohibited Activities

You agree not to:

  • Provide false, misleading, or fraudulent information
  • Impersonate any person or entity
  • Create multiple accounts to circumvent restrictions
  • Upload malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Scrape, crawl, or harvest data from the Service using automated means without permission
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Interfere with the proper functioning of the Service
  • Use the Service for any illegal purpose or in violation of any laws
  • Manipulate air quality sensors to produce false or misleading readings
  • Post offensive, discriminatory, defamatory, or inappropriate content
  • Violate any third party's intellectual property rights
  • Harass, threaten, or abuse other users or our staff

8. Content and Intellectual Property

8.1 Your Content

You retain ownership of content you upload (business descriptions, photos, etc.). By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content in connection with operating and promoting the Service.

You represent and warrant that:

  • You own or have the necessary rights to all content you upload
  • Your content does not violate any third party's rights
  • Your content complies with applicable laws and these Terms

8.2 Our Content

The Service, including its design, software, code, text, graphics, logos, and other content (excluding user-generated content), is owned by CleanAirWhere and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

8.3 Third-Party Content

The Service uses map data from OpenStreetMap, which is available under the Open Database License (ODbL). We also integrate with QingPing's API, which is subject to QingPing's terms and conditions.

9. Data Accuracy and Disclaimers

9.1 Air Quality Data Accuracy

IMPORTANT: Air quality data displayed on CleanAirWhere is provided for informational purposes only and should not be solely relied upon for health or safety decisions.

We do not guarantee the accuracy, completeness, or reliability of air quality measurements. Data may be affected by:

  • Sensor calibration and hardware limitations
  • Sensor placement and environmental factors
  • Network connectivity and data transmission delays
  • User error or sensor tampering
  • Third-party API availability and accuracy

9.2 No Medical or Professional Advice

CleanAirWhere does not provide medical, health, or professional advice. Air quality information should not replace consultation with qualified professionals. If you have health concerns related to air quality, consult a medical professional.

9.3 Business Information

We do not verify the accuracy of business information provided by users. We are not responsible for incorrect addresses, contact information, or misleading business descriptions.

10. Service Availability

We strive to maintain high availability, but we do not guarantee that the Service will be uninterrupted, error-free, or always available. We may:

  • Perform maintenance and updates that temporarily suspend service
  • Experience downtime due to technical issues, third-party failures, or force majeure events
  • Modify, suspend, or discontinue any feature or the entire Service at any time

We will make reasonable efforts to provide advance notice of significant changes or planned maintenance.

11. Third-Party Services and Links

Our Service integrates with and links to third-party services (QingPing, Stripe, Supabase, OpenStreetMap). These third parties have their own terms and privacy policies, which we encourage you to review. We are not responsible for:

  • The availability, accuracy, or content of third-party services
  • Third-party privacy practices or security measures
  • Any damages arising from your use of third-party services

12. Account Termination

12.1 Termination by You

You may delete your account at any time through the dashboard settings or by contacting us. Upon termination:

  • Your business profile will be removed from the public map
  • Your access to the dashboard will be revoked
  • Your personal data will be deleted within 30 days (subject to retention requirements)
  • Historical air quality readings may be retained in aggregated, anonymized form for research

12.2 Termination by Us

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Provision of false information
  • Non-payment of fees (when applicable)
  • Abuse of the Service or harm to other users
  • Any reason at our sole discretion

We will make reasonable efforts to provide notice before termination, except in cases of serious violations or legal requirements.

12.3 Effect of Termination

Upon termination, all licenses and rights granted to you will immediately cease. Provisions that by their nature should survive termination will survive, including disclaimers, limitations of liability, and dispute resolution.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

CleanAirWhere and its officers, directors, employees, agents, and affiliates SHALL NOT BE LIABLE for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, revenue, or business opportunities
  • Loss of data or data corruption
  • Personal injury or health issues related to air quality
  • Property damage
  • Costs of procurement of substitute goods or services
  • Any damages arising from use or inability to use the Service

Our total liability for any claims arising from or related to the Service SHALL NOT EXCEED the amount you paid us in the 12 months preceding the claim (or $100 if you have not paid us any fees).

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

14. Indemnification

You agree to indemnify, defend, and hold harmless CleanAirWhere and its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Content you upload or submit
  • False or misleading information you provide
  • Your breach of any representation or warranty

15. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We disclaim all warranties, including but not limited to:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties that the Service will be uninterrupted, secure, or error-free
  • Warranties regarding the accuracy, reliability, or completeness of content or data
  • Warranties that defects will be corrected

No advice or information obtained from CleanAirWhere shall create any warranty not expressly stated in these Terms.

16. Dispute Resolution

16.1 Informal Resolution

Before filing a legal claim, you agree to first contact us at cleanairwhere@gmail.com to attempt to resolve the dispute informally. We will work in good faith to resolve disputes within 60 days.

16.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CleanAirWhere regarding the Service.

18.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18.3 Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

18.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign or transfer these Terms without restriction.

18.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, pandemics, labor disputes, or government actions.

18.6 Survival

Provisions that by their nature should survive termination shall survive, including but not limited to: intellectual property rights, disclaimers, limitations of liability, indemnification, and dispute resolution.
